Pricing and Payment:

All prices for Face Dunk products are listed on www.facedunk.com and include Australian GST. Delivery charges are additional and specified separately during the ordering process. Payment must be made in advance using one of the payment methods outlined on the Website and considered final only once we have received cleared funds.

Prices are subject to change without notice. We are not obligated to fulfill an order at an incorrect price if the error is clear and obvious, and could reasonably have been recognized by you as such. Accepted payment methods include credit or debit cards (Visa, Visa Debit, Mastercard), as well as PayPal.

Promotional Codes and Discounts:

Face Dunk discount or promotion codes allow you to receive a percentage off your next purchase on www.facedunk.com. To redeem a discount, simply navigate to the "My Cart" section of your account, where you will find an option to "Apply Coupon." Simply enter the code to apply the discount to your order.

Please note the following conditions:

• Discount codes are valid for a one-time use only per customer.
• Codes cannot be combined with any other promotions or offer.
• Codes remain the property of Face Dunk and are non-transferable.
• No cash alternative is available for the discount.
• Codes and discounts do not apply to delivery charges.
• During promotional sales with already discounted prices, codes cannot be used.
• Code are only valid according to the sale period and will not be honoured after.

We also reserve the right to cancel or modify any discount or promotion at our discretion, and to refuse or limit orders at any time.

Returns and Refunds Policy

If you experience any issues with your product or delivery, please reach out to us at hello@facedunk.com to explore possible solutions.

For hygiene reasons, we do not accept returns on Face Dunk products and this policy ensures that every customer receives our products in the highest quality condition.

Please note, all sales are final, and we do not offer refunds for changes of mind. Additionally, items purchased on sale or with a discount are not eligible for refund. Product/s that been monogrammed or limited edition are also final sale and not eligible for return. Shipping fees are non-refundable and are the customer's responsibility.

Delivery Issues and Liability

If we fail to deliver your order, or if the products you receive are not what you ordered, are damaged, defective, or in the wrong quantity, our sole responsibility will be, at our discretion, to:

• Resolve any issues related to shortages, non-delivery, or incorrect delivery;
• Replace or repair any damaged or defective products; or
• Refund the amount paid for the affected products.

This policy applies only in cases where goods are lost in transit or the courier mishandles the delivery. It does not cover situations where goods are returned to us, stolen after delivery, refused, or if incorrect delivery details were provided. Any return shipping costs are at your own expense.

Force Majeure

If a Force Majeure event causing delay occurs, we may terminate this Agreement by giving at least 7 days’ notice to you. Force Majeure means any act, circumstance or omission over which we could not reasonably have exercised control.

Indemnity

To the fullest extent of the law, you herby agree to indemnify and hold harmless Face Dunk Pty Ltd, along with its directors, officers, employees, consultants, agents, and affiliates, from and against any or all claims, liabilities, damages and expenses, for any direct or indirect injury or costs (including legal expenses) arising in any way related to your breach of any of the terms and conditions or use of our website or our products.

Limitation of Liability

Face Dunk Pty Ltd shall only ever by liable to you for losses up to 100% of the total value of the goods purchase. Face Dunk Pty Ltd, along with its directors, officers, employees, consultants, agents, and affiliates, are not responsible for failure to meet any of our obligations under these terms and conditions where such failure is due to events beyond our reasonable control.

We will not be liable for any indirect, consequential, or special damages, including but not limited to loss of revenue, profits, business opportunities, contracts, data, or reputation.

Ownership of Intellectual Property and Website Content

You may not copy, reproduce, distribute, modify, publish, transmit, or create derivative works from any content on the www.facedunk.com website, unless expressly permitted by these terms. Furthermore, all content contained on the Face Dunk website, including trademarks, designs, logos, text, images, illustrations, and other materials, is owned by Face Dunk Pty Ltd.

The Face Dunk trademark, along with all related logos, marks, and the domain name facedunk.com, whether registered or unregistered in your country, are the exclusive property of Face Dunk Pty Ltd and will remain so. You may not reproduce, remove or distribute these trademarks or any content from the website without prior written consent from Face Dunk Pty Ltd. You are permitted to make a copy of face dunk web pages solely for your personal, non-commercial use, provided that all copyright and proprietary notices remain intact.

You agree to the following terms if you tag @face_dunk or using the hashtag #face_dunk:

Granting Face Dunk Pty Ltd, along with its partners, a global, perpetual, irrevocable, royalty-free, non-exclusive, and transferable license to use any content (including photos, videos, or other media) you post on social media platforms such as TikTok, Instagram, Facebook, Twitter, or Google. This license includes the right to use your social media handle, username, profile picture, caption, location, and any other information in your posts for marketing, promotional, and advertising purposes across all forms of media, including but not limited to Face Dunk’s website, social media accounts and third-party platforms.

You further agree to allow Face Dunk Pty Ltd to use your username, real name, image, likeness, or any other identifying information in connection with your User Content, at its discretion. Face Dunk Pty Ltd reserves the right to display, reproduce, modify, combine, distribute, or edit your User Content in any way it sees fit, including for legal or regulatory reasons. This right is granted without any obligation to compensate you for its use.

If you choose to upload or share content tagged with Face Dunk brand hashtags on your social media accounts, you give Face Dunk Pty Ltd permission to use this content. This includes but is not limited to use on websites, promotional emails, advertisements, social media posts, and other marketing campaigns, now or in the future. Face Dunk Pty Ltd may alter, edit, or combine your content with other materials at their sole discretion for the purpose of marketing or advertising, without any obligation to compensate you for its use.
